In an article published in the September/October issue of CFMA Building Profits, Doug Gartenlaub provides guidance for construction professionals on construction defect laws and how they have evolved. Gartenlaub explains that as the construction industry rebounds, construction defect litigation may also increase. He also addresses how other states have reacted, stating that more than 30 states have enacted construction defect notice statutes in one form or another. These statues impose time frames and requirements prior to filing suit, which vary widely from state to state. He concludes the article by suggesting to the readers that they work with their insurance company and legal counsel to assess their risk profile and take the appropriate steps to limit exposure.
