Burr Alert: New HIPAA Rules Issued: “Sweeping” Changes for Healthcare Providers and Business Associates

February 05, 2013

On January 17, 2013, the Department of Health and Human Services (“HHS”) released its longawaited
final HIPAA rule, which significantly expands certain obligations for healthcare providers and their business associates (the “Final Rule”). The Final Rule, which was published in the Federal Register on January 25, 2013, has been described as “the most sweeping changes to the HIPAA Privacy and Security Rules since they were first implemented.” In general, the Final Rule expands HIPAA obligations for business associates and their subcontractors, revises the requirements regarding the use and disclosure of patient information, expands patient rights, clarifies the content of Notice of Privacy Practices to be provided by healthcare providers, modifies the breach notification requirements, and expands enforcement provisions and penalties. The Final Rule is effective March 26, 2013. However, healthcare providers and business associates will have until September 23, 2013 (and in limited circumstances with respect to amending business associate agreements, until September 23, 2014) to achieve compliance with many of the new provisions.

TESTIMONIALS

  • “I have an excellent working relationship with a number of attorneys at the firm, all of whom I trust to handle our problems. Even at a generously negotiated rate, we pay the attorneys at Burr & Forman a slightly higher rate than we pay other attorneys for similar services. We are willing to pay that premium because of the firm’s competence in so many areas, whereas other smaller firms tend to specialize in areas and have weaknesses in others.”

  • “Our firm has used Burr & Forman, and particularly Logan Hinkle, for our retirement plan and many employment law issues over the years.  I have always found their entire staff of lawyers, paralegals and assistants to be knowledgeable and just as importantly prompt in their response to our questions or concerns.  They have always kept us abreast of changes in the law and suggest changes that we should make in our employment practices, or our retirement plan, to keep current and compliant.  Our relationship has always been professional but at the same time very cordial and respectful.  Our association with Logan and his partners, associates and colleagues has been outstanding.”

  • "Lee has been an excellent, trusted legal adviser to Honda Alabama since our arrival in 1999. He's helped us successfully expand our operations from our six initial hires to over 4,000 associates today. Each step along the way he's provided solid legal and insightful business advice. "

  • "I have worked with the Burr & Forman people in Atlanta, Birmingham and Orlando and they are consistently the best around. Their fees tend to come in under similar firms and their work product is superior."

  • “I have had the pleasure of working with Jay Price since 1997.  Over the years, he has provided outstanding representation for the banks I have worked for and continues to make the loan closing process a good experience for both the bank and our borrowers.  Even with the growth of Jay’s practice over the years, he always makes me feel as if I am his only client and always provides me top notch service.”
