Burr & Forman has represented clients in environmental matters since the passage of the first Clean Air Act of 1970. As a result, we have extensive experience in handling regulatory and permitting matters concerning air, water and both solid and hazardous waste before federal, state and local environmental agencies across the country. We also defend enforcement actions brought by those agencies and handle CERCLA and RCRA matters.

Our decade-long representation of a Fortune 500 waste collection company encompasses day-to-day operational issues as well as dispute avoidance and resolution services. This relationship entails handling many suits and administrative actions brought by competitors, local governments and citizens’ groups. In addition, we work extensively with the Alabama Department of Environmental Management, Georgia Department of Natural Resources, Mississippi Department of Environmental Quality and Tennessee Department of Environment and Conservation in dealing with various regulatory and permitting matters. Our close working relationship with the departments proves helpful in guiding our efforts with other regulatory agencies.

Another area of concentration for Burr & Forman’s environmental law practice is toxic tort litigation. Our experience includes defending clients in suits brought by property owners alleging trespass, nuisance and other toxic torts. We also defend manufacturers in toxic tort class action suits against multiple companies and are involved in the defense of asbestos and mining subsidence suits brought by citizens.

Our land-use, zoning and real estate attorneys combine their transactional and litigation experience to most effectively represent clients. Our attorneys are actively involved in hearings before municipal and administrative bodies and regularly handle cases involving condemnation, eminent domain, real property disputes, titles, mining and mineral disputes. Clients in this area include owners of and those involved in the purchase and sale of commercial buildings, large tracts of land, large residential subdivisions, condominiums and other major commercial and residential real estate developments.
