Burr & Forman Files Amicus Brief with United States Supreme Court

On Thursday, June 16, Burr & Forman filed an amicus brief with the Supreme Court of the United States on behalf of the Alabama Nursing Home Association (ANHA) and the Florida Health Care Association (FHCA). The brief is in support of a Petition for Certiorari related to a ruling out of the U.S. Court of Appeals for the Eighth Circuit.

In October of 2021, the Eighth Circuit upheld a regulation limiting the use of pre-dispute arbitration agreements in long-term care admission contracts. The court held that the rule, originally established in 2019 by the Centers for Medicare and Medicaid Services, does not conflict with federal law.

“The 8th Circuit Court of Appeal’s ruling is adverse to nursing homes across the country,” says Angie Cameron Smith, General Counsel to the Alabama Nursing Home Association. “Burr & Forman’s appellate practice is one of the most robust and experienced in the southeast, and we are excited to be representing the ANHA and FHCA in this important petition.”
