Description: On April 21, 2021, the Eleventh Circuit issued one of the more unusual FDCPA decisions in years, holding that a debt collection agency that transmitted information concerning a debt to a letter vendor had made an improper disclosure in violation of section 1692c(b) of the FDCPA.  If the decision stands, it could have broad implications on a collector’s ability to hire vendors or other third-parties to assist with collection efforts.  The full impact of this decision on debt collectors and first-party collectors is unknown, but our panelists will analyze the decision and its potential impact on the industry, and will address potential arguments to use in future litigation.
