David Timm Discusses GenAI Misuse and Legal Risk in Procurement Litigation on GW Law's Beyond the FAR Podcast
Burr's David Timm, Washington, D.C. partner, was featured on GW Law's Beyond the FAR podcast, where he discussed the growing impact of generative artificial intelligence on procurement litigation and the risks associated with its misuse in legal filings. Drawing on his experience representing contractors in bid protests and claims, David examined how large language models ("LLMs") are influencing proceedings before federal procurement tribunals.
During the conversation, David addressed the increasing number of cases involving AI-generated errors, particularly fabricated or inaccurate citations, often called "hallucinations". He explained that these issues can stem from the nature of LLMs, noting that “what it’s doing at a basic level is predicting and generating text,” which can produce outputs that appear authoritative but are not grounded in reality. As a result, both pro se litigants and law firms have submitted filings containing subtle non-existent or misrepresented legal authorities. David highlights that regardless of the tool used, responsibility remains with the filer, stating that “you are still responsible for your filings,” and that verification is essential in high-risk, high-importance contexts such as legal submissions.
David’s discussion highlights the increasing attention being paid to generative AI within the procurement bar and reinforces the importance of disciplined analysis and careful verification when incorporating emerging technologies into legal practice. As these tools continue to evolve, his insights underscore that effective advocacy depends not only on efficiency, but on accuracy, judgment, and accountability.
