Burr & Forman's Kasee Heisterhagen Featured in Law 360 on AshleyMadison's Data Hack
In Law360's August 20, 2015 coverage of the Avid Life hack and subsequent publication of AshleyMadison member data, Kasee Sparks Heisterhagen provided her insights on potential lawsuits filed on behalf of the members whose information was disclosed. Avid Life may face a number of disadvantages in litigation following the breach of 37 million members' data. For example, members will be able to easily identify injury from the breach by pointing to their destroyed relationships and public embarrassment. Another weakness in Avid Life's defense is AshleyMadison's practice of not verifying emails associated with accounts. Heisterhagen notes that email verification is a very basic security step that almost every website uses, even those that don't collect credit card information or other data. "It's a pretty blatant misstep on the part of AshleyMadison," she said.
