In the article "Climate Change Likely to Stay Back-Burner Issue For Obama" that ran on Law360 on Jan. 18, 2013, Atlanta partner, Scott Hitch, is quoted on how climate issues have been put on the back-burner for the Obama administration. Hitch suggests that, although the issues may be low on the totem pole for the administration, policy development at the EPA may be moving ahead. One of the most significant regulatory actions on tap for the next few months is the finalization of Clean Air Act standards for carbon pollution from new power plants that would set up significant barriers to constructing coal-fired facilities. Hitch says the new standards will require fossil-fuel-fired burners larger than 25 megawatts to achieve an emissions rate of 1,000 pounds of carbon dioxide per megawatt-hour.
