Overview

Sean Milani-nia is the leader of Burr & Forman’s government contracts practice. He represents federal contractors in connection with Contract Disputes Act claims, bid protests, and compliance matters. Sean has extensive experience litigating complex claims before the Court of Federal Claims and Boards of Contract Appeals, bid protests before the GAO and Court of Federal Claims, and size protests before the SBA Office of Hearings and Appeals.

Sean also assists contractors in connection with transactional matters, including government contracts focused diligence for mergers & acquisitions, novations, mentor-protege agreements, and joint venture and teaming agreements.

Finally, Sean routinely advises federal contractors on a variety of compliance matters and helps navigate the multitude of regulations and statutes with which they must comply, including SBA regulations, Buy American Act, Civil False Claims Act, Davis-Bacon Act, Service Contract Act, Prompt Payment Act, and Federal Acquisition Regulation business ethics and conduct compliance.

Sean's practice is geographically diverse, having represented contractors on projects throughout the United States and overseas, including Guam, Saudi Arabia, Afghanistan, Qatar, Iraq, Norway, Kyrgyzstan, Georgia, and Poland.

Experience

  • MVL USA, Inc. et al v. United States
    Represented numerous plaintiffs in a consolidated bid protest in the U.S. Court of Federal Claims challenging the requirement for project labor agreements on all federal construction projects valued at $35 million or more. The Court ruled that the project labor agreements in the subject contracts violated the Competition in Contracting Act and were improper.
  • Claims Litigation on U.S. Embassy in Oslo, Norway
    Represented contractor in significant claims litigation concerning construction of the new U.S. Embassy in Oslo, Norway. Secured a $66.3 million settlement with the State Department, which was the largest ever at the time relating to the State Department's Overseas Building Division.
  • Claims Litigation on Al Udeid Air Base, Qatar
    Represented contractor in connection with numerous claims concerning the construction of multiple structures on the Al Udeid Air Base in Qatar. Secured a $12.5 million settlement with the United States Army Corps of Engineers
  • Overturning Terminations for Default
    Represented contractor that was terminated for default by the Air Force on the Prince Sultan Air Base in Saudi Arabia. Successfully overturned the termination for default at the Armed Services Board of Contract Appeals, which issued a decision converting the termination for default into a termination for convenience.

    Represented a dredging contractor that was terminated for default by the United States Army Corps of Engineers in connection with the dredging contract on Schuylkill River. After an Armed Services Board of Contract Appeals mediation, secured a favorable settlement converting the termination for default into a termination for convenience.
  • Defending Termination for Default
    Represented general contractor in suit alleging wrongful termination of its subcontractor. After a weeklong arbitration hearing, the arbitrator rendered a decision upholding proprietary of termination for default.
  • Acquisition of Cleared Federal Cyber Security Contractor
    Represented private equity firm in providing government contracts specific due diligence and guidance in its acquisition of a cleared cyber security government contracting firm. Assisted private equity firm in navigating the facility clearance process associated with acquiring a cleared contractor.
