Overview
Shannon Humiston is an experienced bankruptcy attorney in the firm’s Wilmington office. Her practice focuses on corporate reorganizations, creditors’ rights issues and litigation arising in chapter 11 and chapter 7 bankruptcy cases. Clients rely on Shannon’s practical insights and strong litigation skills to navigate complex financial disputes.
With a practical and results-driven approach, Shannon advises secured and unsecured creditors, committees, ad hoc groups, trustees, plan administrators, lenders, utility companies, landlords, trade vendors, asset purchasers, insurers, equipment lessors, directors/officers and debtors on the complexities of the restructuring process (and their responsibilities within it). In addition to representing creditors in commercial chapter 11 cases, Shannon also has extensive experience litigating commercial disputes in Delaware state courts, including the Court of Chancery. Her collaborative style and thorough understanding of the law make her a trusted advocate for clients both in the courtroom and in out-of-court negotiations.
Additionally, Shannon is deeply committed to the community. She regularly serves on non-profit boards, as a volunteer at her children’s school and as a guardian ad litem for children in Delaware’s foster care system. She has organized expungement clinics and participated in other pro bono projects that promote access to justice.

- Appeared in Delaware State Courts on behalf of lenders seeking remedies against borrowers or collateral.
- Represented financial institution at trial to enforce its lien rights.
- Represented homeowners at trial in nuisance/trespass claims against adjacent landowners.
- Represented homeowners at trial in construction defect litigation.
- Represented homeowners in litigation with insurance company for bad faith refusal to indemnify insured.
- Represented debtors as lead counsel in various chapter 11 bankruptcy cases, including debtors in the oil and gas, cigarette and manufacturing industries.
- Delaware bankruptcy counsel to an electric utility company and its affiliates in chapter 11 cases.
- Co-counsel to creditors’ committee in chapter 11 bankruptcy cases
- Delaware and lead counsel in multiple adversary proceedings alleging fraudulent and/or preferential transfers.
- Represented an ad hoc committee of former customers of failed cryptocurrency business.
- Counseled independent directors on their rights, duties, and obligations related to authorizing an entity's chapter 11 bankruptcy petition-filing.
- Represented secured creditors in hearings on motions for relief from the automatic stay designed to enable them to return to state court to pursue remedies against the underlying collateral, including foreclosure.
- Represented trade vendors and landlords in moving for and receiving payment of administrative expense claims.
- Counseled creditors on available remedies in the assignment for the benefit of creditors in the Delaware Court of Chancery.
