Overview

Dana Robbins-Boehner is a nationally recognized creditors’ rights and financial-services litigator who represents banks, secured lenders, bondholders, landlords, and financial institutions in complex commercial disputes, high-value restructurings, and multi-jurisdictional workouts across the real estate, retail, hospitality, healthcare, maritime, and finance sectors.

As an experienced litigator, Dana tries high-stakes cases in federal district, bankruptcy, and state courts, regularly defending institutional lenders in class actions, complex commercial disputes, and appellate matters. Dana has secured favorable outcomes in cases involving tens of millions of dollars, including a multi-million-dollar verdict in a foreign proceedings supplementary federal trial upheld by the Eleventh Circuit and a successful defense of a $36 million lender-liability action following a multi-day bench trial.

Dana is a recognized leader in the insolvency community and has received the American Bankruptcy Institute’s “40 Under 40” Award, the NCBJ Next Generation honor, and the IWIRC Florida Emerging Leader Award. She has also been repeatedly acknowledged by Best Lawyers: Ones to Watch and Florida Super Lawyers Rising Stars for her work in banking litigation, creditor-debtor rights, and insolvency.

Before entering private practice, Dana served as a federal law clerk to Chief United States Bankruptcy Judge Caryl E. Delano in the Middle District of Florida.

Dana holds a J.D., cum laude, and an M.B.A. from Stetson University, a B.S. in Business Management with honors from the University of Tampa, and studied international comparative law at the University of Oxford.

Experience

  • Successfully defended a $36 million lender liability case for a national banking institution over a four-day bench trial, involving claims of negligent and fraudulent inducement, civil theft, and conversion.
  • Co-chaired fraudulent transfer litigation against an Italian yacht distributor in the U.S. District Court for the Southern District of Florida, including direct and cross-examination of key hostile witnesses, securing a multi-million-dollar verdict affirmed on appeal by the Eleventh Circuit.
  • Opposed a post-sale objection in a $50 million transaction under Bankruptcy Code § 363.
  • Co-chaired trial in a $75 million bond indenture case representing the bond indenture trustee on a motion for a priming lien under Bankruptcy Code § 364 in the U.S. Bankruptcy Court for the Southern District of Florida, including pre-trial preparation and drafting objections.
  • Assisted with preparation and presentation at trial in the confirmation of a $9+ million single-asset real estate case, including drafting objections to the plan and disclosure statement under Bankruptcy Code § 1129, trial exhibit preparation, and development of witness examination outlines.
  • Prevailed in arguing a motion to dismiss an adversary proceeding under the Rooker-Feldman doctrine in the Bankruptcy Court for the Middle District of Florida, involving declaratory relief related to a contested leasehold interest following extensive state court litigation and contemporaneous appeal.
  • Argued multiple bankruptcy appeals before U.S. District Courts, successfully defending against motions to dismiss appeals.
