Overview
Benjamin is an associate in Burr & Forman’s Commercial Litigation practice group, where he represents businesses and organizations in complex commercial disputes throughout South Carolina and the Southeast. His practice encompasses a broad range of business litigation, including construction disputes, contract litigation, commercial torts, fiduciary matters, and other high-stakes civil litigation in both state and federal courts. Benjamin serves his clients in a variety of ways, including serving as outside general counsel.
Benjamin has experience managing every stage of litigation, from pre-suit analysis and strategic counseling through written discovery, depositions, motion practice, mediation, trial preparation, and trial. He regularly drafts dispositive motions, discovery motions, and other significant filings, while advising clients on litigation strategy and risk management.
Benjamin’s representative matters include the defense and prosecution of complex commercial and construction litigation, representation of corporate clients in multi-party business disputes, and litigation involving governmental entities and constitutional issues. He has also represented clients in matters involving contract interpretation, fiduciary obligations, business torts, insurance-related disputes, intellectual property litigation, and commercial real estate issues. Benjamin also serves his clients in an outside general counsel capacity.
Benjamin received his Juris Doctorate from the University of South Carolina School of Law, where he graduated cum laude and was on the Dean’s Honor List for multiple semesters. He also received the CALI award in Interviewing, Counseling and Negotiation. During law school, he was the Associate Editor-in-Chief for the American Bar Association Real Property Trust & Real Estate Law Journal, as well as a law clerk for a large conservation non-profit corporation. Prior to law school, Benjamin graduated cum laude while obtaining his Bachelor of Science in Economics and Finance from the University of South Carolina. During his latter college years and early law school years, Benjamin worked as an Honors Intern for the Federal Bureau of Investigation in Columbia and Washington, DC.
In his free time, Benjamin enjoys offshore fishing, traveling, and spending time with his wife and their two pets. He is also an avid college football fan.
