Overview

Rocky Horde is a Partner in the firm's Real Estate practice group where he focuses on real estate development and finance. Within his real estate practice, Rocky serves his clients through acquisition, finance, leasing, development, redevelopment, operation and disposition in a number of areas, including hotels, office buildings, multi-family developments, resorts, golf courses, country clubs, stadiums, and marinas. In addition to his real estate development and finance practice, Rocky has more than 18 years of commercial mortgage-backed securities loan origination experience.

Experience

  • Represented the “principal occupant” tenant of a downtown Atlanta office building in the Fairlie-Poplar Historic District to obtain approval of all zoning and construction aspects for the installation of a massive digital building sign on the top two sides of the building.
  • Represented the owner of a Buckhead office building in its complete interior and exterior renovation of an existing building that involved installation of completely new building facades and an external lighted glass-enclosed stairway, together with renegotiation of all existing leases and documentation of all new leases.
  • Represented Cobb County in its acquisition, construction and leasing of the new baseball stadium where the Atlanta Braves play (formerly known as SunTrust Park), including the development agreement, stadium lease, master declaration, franchise non-relocation agreement, parent guaranty, and the CC&Rs governing the stadium and The Battery mixed use project.
  • Representing developers and construction lenders in tax abatement bonds and acquisition and construction loans for various hotels around Georgia, and office buildings and student housing in the Atlanta area.
  • Representing leading multi-family apartment developer on myriad projects throughout the Southeast.
  • Represented lead lender in syndication of $198,000,000 USDA guaranteed loan on a renewable diesel production facility in Nevada, the agency’s largest loan in its history.
  • Represented liquidating trustee in the sale of the Ritz-Carlton Hotel and Reynolds Plantation at Lake Oconee, Georgia, including six golf clubs, marinas and other amenities.
  • Division Counsel to Textron Financial Corporation's Golf/Resort Finance Division where Rocky advised his internal clients on all legal aspects of originating, administering, modifying and foreclosing loans, sales out of bankruptcy and receiverships for more than 100 properties throughout the US, Canada and Mexico, including golf clubs, marinas, hotels and unimproved sites for each.

  • Served as primary national loan program documentation and origination counsel for J. P. Morgan's conduit lending program, including preparation of all loan program forms and procedures.
  • Served as Head of Fannie Mae Small Loan Aggregation Program and as the program’s General Counsel.
