David Timm Discusses AI, the RFO, and Bid Protests on “GovCom: It’s a Vibe”
Burr Partner David Timm spoke with Alexa Tsui on the government contracting podcast #GovCom: It’s a Vibe about changes in the procurement space, including the transformational effects of AI usage, the Revolutionary FAR Overhaul (RFO), and bid protest trends.
David describes contractors as being in a “transitional state” due to high AI adoption. He notes that agencies are evaluating bids with inconsistent disclosure of AI use. David recommends a more strategic approach to AI, warning against identical proposals from contractors and emphasizing the need for government agencies to disclose their “high-impact” use of AI in bid evaluations.
But David suggests that the ongoing RFO initiative is more disruptive than AI. He argues that simplifying the rules won’t reduce litigation. Its piecemeal rollout of rule changes has led to inconsistent rule application and several GAO protests, with David predicting more errors ahead.
