Overview
David P.J. Timm represents government contractors in high-stakes bid protests and claims against federal agencies. He Chairs the Bid Protest Committee for the Federal Bar Association and publishes and presents on bid protest developments frequently.
David helps contractors navigate bid protests at the agency level, before the Government Accountability Office, and at the U.S. Court of Federal Claims. David is the Co-Chair of Burr’s Artificial Intelligence Committee. He is on the cutting edge of the implications of AI in federal contracting, including the government’s use of AI to evaluate proposals.
He also pursues monetary claims for clients at the Armed Services and Civilian Boards of Contract Appeals, the Court of Federal Claims, state courts, through arbitration, and in mediation. David guides contractors through contract terminations and recovery of termination settlement proposal costs.
David advises clients on regulatory and compliance matters related to the Small Business Administration’s rules, including size protests and appeals, the 8(a) program, HUBZone, and the Small Business Innovation Research program.
David maintains an active U.S. Top Secret security clearance and serves on the National Association of Surety Bond Producer’s Attorney Advisory Council. David’s peers selected him for inclusion in Best Lawyers: Ones to Watch (2026).
Outside of work, David is passionate about eviction prevention and served for seven years as Chair and Public Interest Representative on the Tenant-Landlord Commission of Arlington County, Virginia.

- Bid Protests
- Secured favorable corrective action in bid protests at the Government Accountability Office and the Court of Federal Claims on behalf of numerous federal contractors.
- Obtained injunctive relief in a Court of Federal Claims bid protest where the Court found the government’s evaluation was arbitrary and capricious.
- Changed federal precedent on the treatment of photocopied bid bond signatures through a successful Court of Federal Claims bid protest.
- Secured injunctive relief on behalf of a small business in a bid protest at the Court of Federal Claims, successfully arguing that the awardee could not perform without its large subcontractor’s license.
- Served on a team representing construction contractors challenging mandatory federal project labor agreement restrictions on large federal projects.
- Termination Litigation
- Defended multiple contractors terminated for default at the Armed Services Board of Contract Appeals, securing favorable settlements converting the termination for default into one for convenience.
