Overview

Mary Stuart King is an associate in the firm's Labor & Employment practice. When providing advice to employers, she takes a proactive approach focused on tackling issues that often lead to litigation. Mary Stuart regularly assists employers in navigating laws concerning labor relations, employment discrimination, and wage and hour issues.

In the area of traditional labor law, Mary Stuart advises clients on avoiding and responding to unfair labor practices, union organizing efforts, corporate campaigns, and work stoppages. Mary Stuart has experience in defending employers in labor arbitrations and in litigation before administrative agencies, such as the National Labor Relations Board.

Mary Stuart also defends employers before state and federal courts, arbitrators, and administrative agencies, on a range of cases involving discrimination, retaliation, and wrongful termination claims under the ADA, ADEA, FLSA, FMLA, Title VII, as well as other state and federal laws. Additionally, she is experienced in responding to and handling investigations of claims filed against employers with the Equal Employment Opportunity Commission, the Department of Labor, the Occupational Safety and Health Administration, among other state and federal agencies.

Experience

  • Led multi-location employer responses to union campaigns to achieve dismissal of petitions before NLRB Region 19 (Seattle).
  • Responded to ULPs on behalf of employers across several NLRB regions, specifically securing withdrawal of 5 joint-employer ULP charges in NLRB Region 13 (Chicago).
  • Developed and presented traditional labor union awareness and leadership training, and union election simulation for supervisors.
  • Seconded to foreign automotive OEM to handle labor and employment-related in-house counsel matters.
  • Litigated employer defense in federal court to obtain summary judgment in a Fourth Circuit Title VII case.
