Rachel Blackmon Cash

Rachel Cash is a partner in Burr & Forman’s General Commercial Litigation practice group, where she represents institutional clients in complex litigation, arbitration, and regulatory matters nationwide, with a particular focus on financial services and consumer finance litigation.

Rachel serves as national and regional counsel for multiple financial institutions and routinely manages matters in courts and arbitration forums across the United States. Known for her practical and collaborative approach, she works closely with clients to understand their business objectives, operational challenges, and risk tolerance, allowing her to develop legal strategies that align with broader business goals. Rachel believes that strong client relationships are the foundation of effective advocacy and strategic counsel, enabling her to identify risks early, develop practical solutions, and guide clients through complex legal and regulatory challenges. Clients value her responsiveness, strategic judgment, and ability to translate complicated legal issues into clear, actionable guidance that supports informed business decisions.

In addition to her client work, Rachel serves as Burr & Forman’s Hiring Partner and as a Co-Chair of the firm’s Recruiting Committee. In these leadership roles, she helps shape the future of the firm by guiding recruiting strategy, strengthening the firm’s talent pipeline, and fostering a culture of professional development, mentorship, and excellence. Rachel is deeply committed to mentoring young attorneys and believes that investing in the next generation of legal professionals is essential to building strong teams and delivering exceptional client service.

Rachel has extensive experience representing financial institutions of all types, including fintech companies, banks, mortgage lenders, credit card issuers, retail lenders, and auto finance companies in individual lawsuits, class actions, arbitrations, and adversary bankruptcy proceedings. She routinely represents clients in matters arising under a variety of state and federal consumer protection statutes, including the Fair Credit Reporting Act (FCRA), Telephone Consumer Protection Act (TCPA), Truth in Lending Act (TILA), Fair Debt Collection Practices Act (FDCPA), and Real Estate Settlement Procedures Act (RESPA).

A significant portion of Rachel’s practice involves representing clients in arbitration proceedings, including complex, high-volume consumer arbitrations and coordinated mass arbitration matters. She advises clients on arbitration strategy, procedural issues, and risk management considerations and has experience navigating the unique operational and legal challenges presented by large-scale arbitration filings. Her experience in both litigation and arbitration enables her to develop comprehensive dispute-resolution strategies that align with clients’ business objectives and address the evolving landscape of consumer disputes.

Drawing on her academic background in finance and real estate, Rachel brings a unique perspective to matters involving financial products and lending practices. She regularly advises clients on regulatory and compliance matters, particularly those involving consumer credit reporting, and has assisted financial institutions in navigating issues arising from data breach incidents and related class action settlements. Combining deep litigation experience with practical business judgment, Rachel helps clients anticipate risk, strengthen compliance programs, and navigate complex legal and regulatory challenges with confidence.

Rachel earned her J.D., summa cum laude, from the University of Alabama School of Law, where she served as Senior Editor of the Alabama Law Review and was elected to the Order of the Coif. She earned her B.S., summa cum laude, in Real Estate and Finance from Florida State University.

She is licensed to practice in Alabama and Florida and is admitted in numerous federal courts throughout the country. Rachel has been recognized as a Mid-South Super Lawyers Rising Star in Civil Defense Litigation since 2020 and was named to Best Lawyers: Ones to Watch in America for Financial Services Regulation Law in 2021 and 2022.

Outside of her legal practice, Rachel is committed to serving her community. She is a member of The Service Guild of Birmingham and has served on the boards of both the Greater Birmingham Humane Society and the Shelby Humane Society, reflecting her longstanding commitment to animal welfare and community service.
